Control of mining activities

The mandate of the Ministère des Ressources naturelles et des Forêts is to ensure that exploration and mining in Québec are carried out in accordance with the Mining Act and its Regulation. The MRNF can, therefore, make any decision regarding a notice of map designation under section 53 of the Mining Act and suspend or revoke a mining right under Chapter VIII of the Mining Act.

The MRNF may also take steps to have a criminal offence issued against a person or mining company who contravenes any of the provisions referred to in sections 314 to 318 of the Mining Act.

Mr. Pirzada carried out mining activities without prior notification to the municipalities and prior authorization from the landowners. Section 65 of the Mining Act provides that the holder of a mining title may only exercise his right of access in accordance with the provisions of section 235 of that Act. Therefore, the holder must obtain the consent of the owner of private land, or the lessee of land leased by the State.
