Chapter VIII \u2013 Offences<\/p>\n

Section 159<\/h1>\n

Every person who contravenes any of the first paragraph of sections 3<\/a> and 5<\/a>, section 17<\/a>, the first paragraph of section 19<\/a>, sections 20 to 22<\/a>, 25<\/a>, 26<\/a> and 32<\/a>, the first paragraph of section 34<\/a>, sections 38 to 40<\/a>, 42<\/a>, 43<\/a> and 47<\/a>, the first paragraph of section 48<\/a>, section 50<\/a>, the second paragraph of sections 52<\/a>, 54<\/a> and 55<\/a>, sections 59<\/a> and 66<\/a>, the first and second paragraphs of section 67<\/a>, section 68<\/a>, the first paragraph of section 70<\/a>, sections 87<\/a>, 88<\/a>, 89<\/a>, 124<\/a> and 128<\/a> to 130<\/a>, and the third paragraph of section 136<\/a>, commits an offence and is liable to the fine provided for in paragraph 4 of section 245 of the Sustainable Forest Development Act \"This<\/a> (chapter A-18.1).<\/p>\n

The following persons also commits an offence and are liable to the same fine as the fine referred to in the first paragraph:<\/p>\n

    \n
  1. every person referred to in the second paragraph of section 3<\/a>, the first paragraph of section 4<\/a>, sections 64<\/a>, 65<\/a>, 86<\/a>, 93<\/a>, 94<\/a>, 97<\/a> and 98<\/a>, the fourth paragraph of section 99<\/a>, section 100<\/a>, the second paragraph of section 101<\/a>, sections 109<\/a>, 115<\/a> and 116<\/a>, the first and second paragraphs of section 117<\/a>, and sections 125 to 127<\/a> who contravenes any provision of those sections concerning the person;<\/li>\n
  2. every person having the right to carry out a forest development activity or the third person to whom the person has entrusted the carrying out of that activity who contravenes any provision of sections 10<\/a>, 12<\/a> to 16<\/a> and 18<\/a>, the second and third paragraphs of section 31<\/a>, the second paragraph of sections 33<\/a> and 34<\/a>, sections 36<\/a> and 44<\/a>, the second and third paragraphs of section 48<\/a>, the third paragraph of section 54<\/a>, the section 60<\/a>, the first paragraph of section 61<\/a>, sections 63<\/a>, 71 to 77<\/a>, 79 to 83<\/a>, 90<\/a>, 92<\/a>, 95<\/a> and 96<\/a>, the first, second and third paragraphs of section 99, the first paragraph of section 101<\/a>, sections 102 to 106<\/a>, 108<\/a>, 110 to 114<\/a>, 131<\/a>, 133<\/a>, 134<\/a>, 141 to 143<\/a>, 145<\/a>, 146 and 149<\/a><\/li>\n
  3. every holder of a forestry permit referred to in the second paragraph of section 29<\/a> and sections 84<\/a>, 85<\/a> and 154<\/a> who contravenes any provision of those sections concerning the permit holder;<\/li>\n
  4. every holder of a mining right referred to in section 30<\/a> who contravenes the second paragraph of that section;<\/li>\n
  5. every owner of logging machines who contravenes section 41;<\/li>\n
  6. every person opening or operating a sandpit referred to in section 118<\/a> who contravenes any of sections 119<\/a> and 121 to 123<\/a><\/li>\n
  7. every holder of a a lease to mine surface mineral substances referred to in section 140<\/a> of the Mining Act \"This<\/a> (chapter M-13.1) who contravenes section 120<\/a>.<\/li>\n<\/ol>\n
