Woodland caribou habitat, woodland ecotype<\/p>\n<h1>Section 59<\/h1>\n<p>In the application zone of the <a title=\"This link opens a new window\" href=\"\/documents\/faune\/especes\/Plan-retablissement2013-2023.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Plan de r\u00e9tablissement du caribou forestier<\/a> <img decoding=\"async\" src=\"\/wp-content\/uploads\/lien_externe.png\" alt=\"This link opens a new window\" \/> (in French only) under a program referred to in paragraph 2 of section 7 of the <a title=\"This link opens a new window\" href=\"http:\/\/legisquebec.gouv.qc.ca\/en\/ShowDoc\/cs\/E-12.01#se:7\" target=\"_blank\" rel=\"noopener noreferrer\">Act respecting threatened or vulnerable species<\/a> <img decoding=\"async\" src=\"\/wp-content\/uploads\/lien_externe.png\" alt=\"This link opens a new window\" \/>\u00a0(chapter E-12.01), no forest development activity may be carried out in a territory of 4 ha or more in a single block, of the LA1 or RE1 ecological type or recognized as being dry bare soil with lichen. That plan is accessible on the website of the department within which the Minister responsible for the application of that plan carries out duties.\u00a0<img loading=\"lazy\" decoding=\"async\" src=\"\/wp-content\/uploads\/drapeau-texte.png\" alt=\"\" width=\"18\" height=\"18\" \/><\/p>\n<div class=\"disposition\">\n<h2>1<\/h2>\n<h4>Objectives<\/h4>\n<ul>\n<li>To preserve the integrity of a wildlife habitat<\/li>\n<li>To maintain the components of the forest cover that provide shelter for wildlife<\/li>\n<li>To maintain the components of the forest cover that provide food for wildlife<\/li>\n<\/ul>\n<h4><\/h4>\n<h4>Additional information<\/h4>\n<p>It is important to note that the definition of the term \u201cforest development activity\u201d in <a href=\"https:\/\/mrnf.gouv.qc.ca\/en\/RADF\/guide\/chapter-i\/section-2\/\">section 2<\/a> of the Regulation means that the standards set out in sections <a href=\"https:\/\/mrnf.gouv.qc.ca\/en\/RADF\/guide\/chapter-ii\/section-3\/\">3<\/a>, <a href=\"https:\/\/mrnf.gouv.qc.ca\/en\/RADF\/guide\/chapter-ii\/section-5\/\">5<\/a>, <a href=\"https:\/\/mrnf.gouv.qc.ca\/en\/RADF\/guide\/chapter-ii\/section-19\/\">19 to 22<\/a>, <a href=\"https:\/\/mrnf.gouv.qc.ca\/en\/RADF\/guide\/chapter-iv\/section-47\/\">47<\/a>, <a href=\"https:\/\/mrnf.gouv.qc.ca\/en\/RADF\/guide\/chapter-iv\/section-50\/\">50<\/a>, <a href=\"https:\/\/mrnf.gouv.qc.ca\/en\/RADF\/guide\/chapter-iv\/section-52\/\">52<\/a>, <a href=\"https:\/\/mrnf.gouv.qc.ca\/en\/RADF\/guide\/chapter-iv\/section-54\/\">54<\/a>, <a href=\"https:\/\/mrnf.gouv.qc.ca\/en\/RADF\/guide\/chapter-iv\/section-55\/\">55<\/a>, <a href=\"https:\/\/mrnf.gouv.qc.ca\/en\/RADF\/guide\/chapter-iv\/section-57\/\">57<\/a> and <a href=\"https:\/\/mrnf.gouv.qc.ca\/en\/RADF\/guide\/chapter-iv\/section-59\/\">59<\/a> do not apply to the repair, maintenance or closure of forest roads or to the control of fires, insect epidemics and cryptogamic diseases.<\/p>\n<p><a href=\"\/wp-content\/uploads\/Art059_anglais-web.jpg\" carried out there if it is authorized as part of an activity or project for which a certificate of authorization was issued following a decision of the authority concerned made under section <a href=\"http:\/\/legisquebec.gouv.qc.ca\/en\/ShowDoc\/cs\/Q-2#se:31_5\">31.5<\/a>, <a href=\"http:\/\/legisquebec.gouv.qc.ca\/en\/ShowDoc\/cs\/Q-2#se:164\">164<\/a> or <a href=\"http:\/\/legisquebec.gouv.qc.ca\/en\/ShowDoc\/cs\/Q-2#se:201\">201<\/a> of the <a title=\"This link opens a new window\" href=\"http:\/\/legisquebec.gouv.qc.ca\/en\/ShowDoc\/cs\/Q-2\/\" target=\"_blank\" rel=\"noopener noreferrer\">Environment Quality Act <img decoding=\"async\" src=\"\/wp-content\/uploads\/lien_externe.png\" alt=\"This link opens a new window\" \/><\/a>\u00a0(chapter Q-2) or if it is authorized by the Minister as part of the application of the <a title=\"This link opens a new window\" href=\"http:\/\/legisquebec.gouv.qc.ca\/en\/ShowDoc\/cs\/A-18.1\" target=\"_blank\" rel=\"noopener noreferrer\">Sustainable Forest Development Act <img decoding=\"async\" development activities in or near a particular place<\/li>\n<\/ul>\n<h4><\/h4>\n<h4>Explanations<\/h4>\n<p>A person holding a certificate of authorization issued under section <a href=\"http:\/\/legisquebec.gouv.qc.ca\/en\/ShowDoc\/cs\/Q-2#se:31_5\">31.5<\/a>, <a href=\"http:\/\/legisquebec.gouv.qc.ca\/en\/ShowDoc\/cs\/Q-2#se:164\">164<\/a> or <a href=\"http:\/\/legisquebec.gouv.qc.ca\/en\/ShowDoc\/cs\/Q-2#se:201\">201<\/a> of the <a title=\"This link opens a new window\" href=\"http:\/\/legisquebec.gouv.qc.ca\/en\/ShowDoc\/cs\/Q-2\/\" carry out a forest development activity in a territory of 4 ha or more in a single block, of the LA1 or RE1 ecological type or recognized as being dry bare soil with lichen. Although a certificate of authorization has been issued, authorization must also be obtained from the Minister responsible for applying the <a title=\"This link opens a new window\" href=\"http:\/\/legisquebec.gouv.qc.ca\/en\/ShowDoc\/cs\/A-18.1\" target=\"_blank\" rel=\"noopener noreferrer\">Sustainable Forest Development Act <img decoding=\"async\" src=\"\/wp-content\/uploads\/lien_externe.png\" alt=\"This link opens a new window\" \/><\/a> , who will specify the forest development activities that are authorized and set the conditions that must be met when carrying them out.<\/p>\n<p>Under the <a title=\"This link opens a new window\" href=\"http:\/\/legisquebec.gouv.qc.ca\/en\/ShowDoc\/cs\/A-18.1\" target=\"_blank\" rel=\"noopener noreferrer\">Sustainable Forest Development Act <img decoding=\"async\" src=\"\/wp-content\/uploads\/lien_externe.png\" alt=\"This link opens a new window\" \/><\/a>, it is also possible to authorize a forest development activity in a territory of 4 ha or more in a single block, of the LA1 or RE1 ecological type or recognized as being dry bare soil with lichen. Before granting authorization, the Minister\u00a0responsible for applying that Act must consult the Minister responsible for applying the Act respecting the conservation and development of wildlife to obtain his or her opinion of the mitigation measures that have been recommended to maintain the essential components of the woodland caribou, woodland ecotype habitat. In light of the opinion, the Minister responsible for applying the Sustainable Forest Development Act may then give authorization, specifying which forest development activities are authorized and setting the conditions that must be met when they are carried out.<\/p>\n<\/div>\n<p>This section does not apply to a person who, in accordance with section 41 of the <a title=\"This link opens a new window\" href=\"http:\/\/legisquebec.gouv.qc.ca\/en\/ShowDoc\/cs\/A-18.1\" target=\"_blank\" rel=\"noopener noreferrer\">Sustainable Forest Development Act <img decoding=\"async\" src=\"\/wp-content\/uploads\/lien_externe.png\" alt=\"This link opens a new window\" \/><\/a>, has been authorized by the Minister to build or improve a road in a forest stand referred to in the first paragraph of this section, nor to a person who has obtained such authorization under a forestry permit or a contract or agreement entered into under that Act.\u00a0<img loading=\"lazy\" decoding=\"async\" src=\"\/wp-content\/uploads\/drapeau-texte.png\" alt=\"\" width=\"18\" height=\"18\" \/><\/p>\n<div class=\"disposition\">\n<h2>3<\/h2>\n<h4>Objective<\/h4>\n<ul>\n<li>To protect forest resources during particular construction or improvement work on a road, bridge or culvert<\/li>\n<\/ul>\n<h4><\/h4>\n<h4>Explanations<\/h4>\n<p>A person authorized by the Minister in compliance with section 41 of the <a title=\"This link opens a new window\" href=\"http:\/\/legisquebec.gouv.qc.ca\/en\/ShowDoc\/cs\/A-18.1\" target=\"_blank\" rel=\"noopener noreferrer\">Sustainable Forest Development Act <img decoding=\"async\" src=\"\/wp-content\/uploads\/lien_externe.png\" alt=\"This link opens a new window\" \/><\/a> (chapter A-18.1) may build or improve a road across a territory of 4 ha or more in a single block, of the LA1 or RE1 ecological type or recognized as being dry bare soil with lichen. The Minister may grant authorization and set the conditions to be met when carrying out the work.<\/p>\n<h4><\/h4>\n<h4>Additional information<\/h4>\n<p>A person wishing to obtain authorization must complete the following steps:<\/p>\n<ol>\n<li><span>Fill out the <a href=\"https:\/\/mrnf.gouv.qc.ca\/documents\/forest\/radf\/FO_MAJ_Formulaire_41_V3_ang.docx\">LADTF Section 41 Authorization Application Form<\/a> <\/span><img decoding=\"async\" src=\"https:\/\/mrnf.gouv.qc.ca\/wp-content\/uploads\/lien_externe.png\" alt=\"Ce lien ouvre une nouvelle fen\u00eatre\" \/><span> <\/span><\/li>\n<li><span>Have it signed by a forest engineer;<\/span><\/li>\n<li><span>Forward it to the <a href=\"https:\/\/www.quebec.ca\/gouvernement\/ministeres-organismes\/ressources-naturelles-forets\/coordonnees-structure\/reseau-regional\" target=\"_blank\" rel=\"noopener\">management unit in the region<\/a> <img decoding=\"async\" src=\"https:\/\/mrnf.gouv.qc.ca\/wp-content\/uploads\/lien_externe.png\" alt=\"Ce lien ouvre une nouvelle fen\u00eatre\" \/> (in French only) where the project is located. <\/span><\/li>\n<\/ol>\n<p>The <span>applicant <\/span>must include a description of the situation justifying the use of standards that differ from those enacted in this Regulation, and must propose the alternative measures that the <span>applicant <\/span>intends to implement to achieve the objectives of the regulatory standards that will not be applied.
