{"id":95332,"date":"2018-05-22T08:23:24","date_gmt":"2018-05-22T12:23:24","guid":{"rendered":"https:\/\/mrnf.gouv.qc.ca\/RADF\/section-30\/"},"modified":"2026-03-04T13:15:11","modified_gmt":"2026-03-04T18:15:11","slug":"section-30","status":"publish","type":"cpt_radf","link":"https:\/\/mrnf.gouv.qc.ca\/en\/RADF\/guide\/chapter-iii\/section-30\/","title":{"rendered":"Section 30"},"content":{"rendered":"<p>[et_pb_section bb_built=&#8221;1&#8243; _builder_version=&#8221;3.0.94&#8243; module_class=&#8221;bg-radf&#8221; box_shadow_color=&#8221;#000000&#8243;][et_pb_row _builder_version=&#8221;3.0.94&#8243; module_class=&#8221;wrapper-radf&#8221;][et_pb_column type=&#8221;4_4&#8243;][et_pb_text _builder_version=&#8221;3.3.1&#8243;]<\/p>\n<p>Chapter III \u2013 Protection of aquatic environments, riparian areas, wetlands and soils<br \/>\nDivision II &#8211; Open peat bogs (unwooded) with a pond, marshes, riparian shrub swamps, lakes and permanent watercourses<\/p>\n<h1>Section 30<\/h1>\n<p>Despite section 27, the holder of a mining right to whom a forestry permit was issued who lays out an access to an open peat bog with a pond, to a marsh, to a riparian shrub swamp, to a lake or to a permanent watercourse in order to carry out mining exploration work or to install equipment required for such work may clear an opening not wider than 5 m in the strip of woodland. <img loading=\"lazy\" decoding=\"async\" src=\"\/wp-content\/uploads\/drapeau-texte.png\" alt=\"\" width=\"18\" height=\"18\" \/><\/p>\n<div class=\"disposition\">\n<h2>1<\/h2>\n<h4>Objective<\/h4>\n<ul>\n<li>To reconcile the various activities that take place in the forest<\/li>\n<\/ul>\n<h4><\/h4>\n<h4>Explanations<\/h4>\n<p>A holder of mining rights who also holds a forestry permit may clear an opening no wider than 5 m in the strip of woodland alongside an open peat bog with a pond, a marsh, a riparian shrub swamp, a lake or a permanent watercourse, in order to gain access for the purpose of carrying out mining exploration work, or to install the equipment required for that work.<\/p>\n<p>The Minister responsible for applying the <a title=\"This link opens a new window\" href=\"http:\/\/legisquebec.gouv.qc.ca\/en\/ShowDoc\/cs\/A-18.1\" target=\"_blank\" rel=\"noopener\">Sustainable Forest Development Act <img decoding=\"async\" src=\"\/wp-content\/uploads\/lien_externe.png\" alt=\"This link opens a new window\" \/><\/a>\u00a0may, when giving authorization, specify, in the forestry permit, the forest development activities that are authorized and the conditions that must be met when carrying them out.<\/p>\n<h4><\/h4>\n<h4>Additional information<\/h4>\n<p>The <a title=\"This link opens a new window\" href=\"http:\/\/legisquebec.gouv.qc.ca\/en\/ShowDoc\/cs\/A-18.1\" target=\"_blank\" rel=\"noopener\">Sustainable Forest Development Act <img decoding=\"async\" src=\"\/wp-content\/uploads\/lien_externe.gif\" alt=\"This link opens a new window\" \/><\/a>\u00a0states that a forestry permit is required to carry out certain forest development activities in forests in the domain of the State (<a href=\"http:\/\/legisquebec.gouv.qc.ca\/en\/ShowDoc\/cs\/A-18.1#se:73\">section 73<\/a>).
