{"id":95292,"date":"2018-04-13T13:07:25","date_gmt":"2018-04-13T17:07:25","guid":{"rendered":"https:\/\/mrnf.gouv.qc.ca\/RADF\/section-6\/"},"modified":"2026-03-04T13:14:13","modified_gmt":"2026-03-04T18:14:13","slug":"section-6","status":"publish","type":"cpt_radf","link":"https:\/\/mrnf.gouv.qc.ca\/en\/RADF\/guide\/chapter-ii\/section-6\/","title":{"rendered":"Section 6"},"content":{"rendered":"<p>[et_pb_section bb_built=&#8221;1&#8243; _builder_version=&#8221;3.0.94&#8243; module_class=&#8221;bg-radf&#8221; box_shadow_color=&#8221;#000000&#8243;][et_pb_row _builder_version=&#8221;3.0.94&#8243; module_class=&#8221;wrapper-radf&#8221;][et_pb_column type=&#8221;4_4&#8243;][et_pb_text _builder_version=&#8221;3.9&#8243;]<\/p>\n<p class=\"titre-section\">Chapter II \u2013 Protection of particular places and territories<br \/>\nDivision 1- General<br \/>\n\u00a71 &#8211; Prohibited forest development activities<\/p>\n<h1>Section 6<\/h1>\n<p>Subparagraphs 2 to 10 and 13 to 21 of the first paragraph of <a href=\"\/en\/RADF\/guide\/chapter-ii\/section-3\/\">section 3<\/a> do not apply to the holder of a forestry permit issued for forest development activities carried out by the holder of mining rights for the purposes of exercising his or her rights, unless the mining activities are to extract surface mineral substances, nor to the holder of a forestry permit issued for wildlife, recreational or agricultural development projects.<\/p>\n<p>Subparagraphs 2 to 11 and 13 to 21 of the first paragraph of <a href=\"\/en\/RADF\/guide\/chapter-ii\/section-3\/\">section 3<\/a> do not apply to a holder of a forestry permit issued for public utility works.&nbsp;<img decoding=\"async\" src=\"\/wp-content\/uploads\/drapeau-texte.png\" alt=\"Flag 1\"><\/p>\n<div class=\"disposition\">\n<h2>1<\/h2>\n<h4>Objective<\/h4>\n<ul>\n<li>To allow certain forest development activities in or near a particular place<\/li>\n<\/ul>\n<h3><\/h3>\n<h3>Explanations<\/h3>\n<p>A person holding a forestry permit may carry out the forest development activities required for wildlife, recreational or agricultural development projects at the places and in the territories specified in subparagraphs 2 to 10 and 13 to 21 of the first paragraph of <a href=\"\/en\/RADF\/guide\/chapter-ii\/section-3\/\">section 3<\/a>. A holder of mining rights who also holds a forestry permit may also carry out forest development activities at those places and in those territories, unless the mining activities are to extract surface mineral substances. The places and territories in question are:<\/p>\n<p><a href=\"\/wp-content\/uploads\/Art006-tableau_anglais-web.jpg\" target=\"_blank\" rel=\"noopener\"><img decoding=\"async\" class=\"alignnone\" src=\"\/wp-content\/uploads\/Art006-tableau_anglais-web.jpg\" width=\"520\"><\/a><\/p>\n<p>In addition, a person who holds a forestry permit may carry out the forest development activities required for public utility works at the places and in the territories specified in subparagraphs 2 to 11 and 13 to 21 of the first paragraph of <a href=\"\/en\/RADF\/guide\/chapter-ii\/section-3\/\">section 3<\/a>. The places and territories in question are:<\/p>\n<p><a href=\"\/wp-content\/uploads\/Art006-tableau_anglais-web.jpg\" target=\"_blank\" rel=\"noopener\"><img decoding=\"async\" class=\"alignnone\" src=\"\/wp-content\/uploads\/Art006-tableau_anglais-web.jpg\" width=\"520\"><\/a><\/p>\n<p>The Minister responsible for applying the <a title=\"This link opens a new window\" href=\"http:\/\/legisquebec.gouv.qc.ca\/en\/ShowDoc\/cs\/A-18.1\" target=\"_blank\" rel=\"noopener\">Sustainable Forest Development Act <img decoding=\"async\" src=\"\/wp-content\/uploads\/lien_externe.png\" alt=\"This link opens a new window\"><\/a>&nbsp;specifies which forest development activities are authorized in the forestry permit and sets the conditions to be met when they are carried out.<\/p>\n<h3><\/h3>\n<h3>Additional information<\/h3>\n<p>The <a title=\"This link opens a new window\" href=\"http:\/\/legisquebec.gouv.qc.ca\/en\/ShowDoc\/cs\/A-18.1\" target=\"_blank\" rel=\"noopener\">Sustainable Forest Development Act <img decoding=\"async\" src=\"\/wp-content\/uploads\/lien_externe.gif\" alt=\"This link opens a new window\"><\/a>&nbsp;states that a forestry permit is required to carry out certain forest development activities in forests in the domain of the State (<a href=\"http:\/\/legisquebec.gouv.qc.ca\/en\/ShowDoc\/cs\/A-18.1#se:73\">section 73<\/a>).
